Privacy Policy

Who we are

Data controller: Marco Martinelli, freelancer, VAT PT 310502470 (Portugal). Contact: hello@feelclear.me.

What we collect

  • Account: email (required), name (optional), your selected preferences. We also store locale, IP address, and user agent sent by your browser.
  • Cookies/local storage: one HttpOnly, SameSite=Strict, Secure cookie for rate limiting (~15 minutes). Local storage saves your analytics choice and theme.
  • Analytics: Google Analytics 4 loads only if you accept in the banner. We also use Vercel Analytics (aggregate).
  • AI features (optional, app only): if you enable AI features, we process voice recordings (deleted after transcription), transcripts, your tone/voice preferences, and generated meditation audio. See "AI-powered features" below.

How we use data

  • Provide the FeelClear service and communications you requested.
  • Protect the service (rate‑limiting and abuse prevention).
  • Improve the site (optional analytics; you can decline).

AI-powered features (FeelClear app)

If you enable AI features in the FeelClear app, we process the following to personalise your meditation:

  • Voice recording: When you tap to record, your audio is sent to our transcription provider to convert it to text. The audio recording is deleted from your device immediately after transcription and is not stored on our servers.
  • Transcription: The text transcript of what you said is used to understand your current state and generate your meditation.
  • Your preferences: Tone, voice style, and language settings you've chosen.
  • Emotional analysis: The transcript is analysed to adapt the meditation to how you're feeling. We do not store the emotional inference as a profile attribute.
  • Meditation script: A short guided meditation script is generated for your session.
  • Voice generation: The script is converted into spoken audio you can listen to.

We only send what each step needs. You can turn AI features off at any time in the app's Settings.

AI sub-processors

  • OpenAI (United States) — voice transcription (Whisper) and emotional analysis (GPT).
  • Anthropic (United States) — meditation script generation (Claude).
  • ElevenLabs (United States) — voice synthesis (text-to-speech).
  • Supabase (already listed) — proxies these calls from our backend to enforce authentication and quota limits; does not retain the content of AI requests.

These providers act as processors under our instructions. OpenAI and Anthropic do not use API data to train their models by default. ElevenLabs processes audio under their own privacy policy; please refer to it for details on their data practices.

Legal basis: your explicit consent, given through the in-app AI consent prompt. You can withdraw it at any time in Settings; withdrawal does not affect processing that already occurred.

Retention: your input voice recordings are deleted immediately after transcription and are not stored on our servers. Text transcripts of your sessions are retained for the lifetime of your account and for up to 12 months after account deletion, after which they are permanently deleted. Transcripts may also be used in aggregate and de-identified form to improve FeelClear; they are never sold or shared for third-party purposes. Generated meditation audio is not stored as personal data.

Legal bases

  • Performance of a contract — delivering meditation sessions, processing your voice input, generating audio, managing purchases.
  • Consent — optional voice recording, AI processing, marketing emails, optional analytics. You can withdraw at any time.
  • Legitimate interests — security, rate-limiting, crash diagnostics, basic product metrics. You can object at any time.
  • Legal obligation — retaining purchase records for Portuguese tax/accounting law.

Sharing/processing

  • Supabase (database/serverless/AI proxy), Google (GA4), Plausible, Vercel (hosting/analytics), and Sentry (error monitoring) act as processors. For AI features in the app, we additionally use OpenAI, Anthropic, and ElevenLabs as sub-processors — see "AI-powered features" above.

Retention

  • Account data: until you delete your account, or 24 months after your last interaction.
  • Voice recordings: not retained after transcription (see "AI-powered features").
  • Transcripts: lifetime of account + up to 12 months (see "AI-powered features").
  • Rate‑limit cookie: ~15 minutes. Local storage: until you clear it.

Your rights

Under the GDPR you can: access, rectify, erase, restrict, port, and object to processing of your data; withdraw consent at any time (without affecting prior processing); and lodge a complaint with your supervisory authority — in Portugal, the CNPD; EU users may also contact their local authority. We do not make decisions with legal or similarly significant effects based solely on automated processing.

To exercise your rights, email hello@feelclear.me. We respond within 30 days, extendable by up to two further months for complex requests.

International transfers

Some processors are located outside the EU/EEA, including in the United States (OpenAI, Anthropic, ElevenLabs, Supabase, Vercel, Sentry). Transfers rely on the European Commission's Standard Contractual Clauses and, where applicable, the EU–US Data Privacy Framework. A summary of safeguards is available on request.

Children

Not intended for children under 16. If we learn we collected such data, we will delete it.

Changes

We will post updates here and change the effective date.
